Austria's Financial Market Authority (FMA) fined Bitpanda GmbH €70,000 for three breaches of the EU's Markets in Crypto-Assets Regulation. The FMA published the decision on Aug 14, 2026, making it the regulator's first public MiCA penalty. Bitpanda failed to notify the FMA of a crypto-asset whitepaper at least 20 business days before publication.

The company also circulated a marketing communication before the associated whitepaper had been published. That same marketing piece omitted required disclosures, including a disclaimer that no authority had reviewed or approved the content, a responsibility statement from the offeror, and contact details. The FMA combined all three violations into a single enforcement decision.

Bitpanda, founded in Vienna in 2014, holds MiCA authorisation for custody, trading, and order execution of crypto-assets.

Implications

  2. Embedded-finance and BaaS platforms offering crypto services should review MiCA white paper submission timelines and marketing disclosure requirements
